The 9/11 attacks by Al Qaeda (i New York og Washington DC) in 2001 led to a very harsh democratic policy toward enemy prisoners, led by the United States but supported by various allies.

The US has not yet developed a clear and systematic way to process enemy prisoners including terror suspects, and the change from President Bush to Obama has not resolved the confusion.

On the issue of abusive interrogation, Obama’s policy is somewhat different from the Bush era. But other successful terrorist attacks would likely revive demands for torture and other cruel treatment.

Professor Forsythe will be discussing these themes as well as the Israeli framework: an absolute legal ban on torture and other cruelty, but theoretical allowance for the necessity defence.
